ScoopFun Discount Voucher App - Terms and Conditions

Introduction

1.1 Agreement Overview

This document constitutes a legally binding agreement between the merchant ("you" or "Merchant") and ScoopFun ("we," "us," or "ScoopFun"), governing your use of the ScoopFun discount voucher app.

1.2 Acceptance of Terms

By registering as a merchant on the ScoopFun app, you agree to comply with and be bound by these terms and conditions.

Merchant Obligations

2.1 Account Registration

You must provide accurate, current, and complete information during the registration process and keep your account information updated.

2.2 Voucher Offers

You must clearly define the terms and conditions of each discount voucher you offer through ScoopFun, including expiration dates, any restrictions, and the redemption process.

2.3 Compliance with Laws

Ensure that all offers comply with applicable laws, regulations, and industry standards.

2.4 Service Quality

Deliver products and services as described in your offers and provide excellent customer service to ScoopFun users.

2.5 Profile Creation

Create a profile with a clear brand name, accurate details, and complete information, including store opening hours.

2.6 Voucher Listing

You may list any number of vouchers you wish. Vouchers will not expire unless you deactivate them from your dashboard.

2.7 Voucher Validation

You are responsible for validating all vouchers according to the conditions specified in the voucher details, even if the vouchers have been deactivated but not expired.

2.8 Update Information

Update any changes to store opening hours, address, or other details affecting customers on ScoopFun immediately.

2.9 Change of Ownership

Notify ScoopFun immediately in the event of a change in business ownership.

2.10 Exclusive Vouchers

You agree to provide exclusive vouchers for ScoopFun only and will not publish the same vouchers on any other platform.

2.11 Administrative Fees

By signing up with ScoopFun, you agree to allow ScoopFun to collect 10% of the voucher amount as an administration fee for individual vouchers. Alternatively, ScoopFun may sell bundles of vouchers (ScoopFun book) and charge a fixed administration fee to customers. These charges may be reviewed and changed by ScoopFun without prior notice to merchants or customers.

2.12 Voucher Redemption

You are responsible for the redemption of every voucher from your dashboard. Failure to do so is your full responsibility.

2.13 Clear Terms and Conditions

All terms and conditions must be clearly mentioned on the voucher page to avoid misunderstandings or confusion for customers. This is your responsibility.

Customer Obligations

3.1 Voucher Validity

Vouchers are valid for a maximum of 12 months from the purchase date.

3.2 Redemption Conditions

Vouchers must be redeemed according to the merchant conditions published on ScoopFun.

3.3 No Cash Redemption

ScoopFun vouchers cannot be exchanged for cash from merchants.

3.4 Merchant Deal Changes

ScoopFun does not guarantee any merchant deals. Merchants have the right to change or completely stop their deals on the ScoopFun portal at any time without prior notice to customers or ScoopFun.

3.5 Administration Cost

Customers pay 10% of the voucher value or a fixed amount as displayed on the voucher deal page or on the ScoopFun voucher book purchase page as a ScoopFun administration cost for individual vouchers, and a fixed amount as displayed for ScoopFun voucher books. This cost can be changed at any time without prior notice and will be displayed on the ScoopFun portal.

3.6 Non-Combining Offers

Vouchers cannot be combined with any other store specials or online specials.

3.7 Voucher Book

ScoopFun voucher books consist of 10 single-use vouchers unless otherwise specified.

3.8 Voucher Code Delivery

Voucher codes will be automatically sent to the customer's email address. Customers are responsible for ensuring their email address is correct in their profile and for keeping the code for their use only.

3.9 Single Use

Voucher codes are single-use only. However, customers can redeem a maximum of three ScoopFun vouchers during any one visit per store.

3.10 Multiple Redemptions

Customers can redeem a maximum of two vouchers per visit per merchant, allowing them to choose different deals from the same merchant if available.

3.11 Group Buying

For group buying or family use, customers must buy separate vouchers for each member as the vouchers are single-use only.

3.12 Voucher Expiry

Vouchers are only valid until their expiry date and must be redeemed before that according to the merchant’s terms and conditions.

Refund Policy

4.1 Merchant Agreement

We have an agreement with all merchants publishing their vouchers on ScoopFun to validate all valid vouchers, but ScoopFun cannot guarantee this. In such cases, customers can report to ScoopFun if a merchant is not validating their published vouchers.

4.2 Partial Refund

Since customers are paying ScoopFun only part of the voucher price, the maximum refund will be the amount paid minus service/handling charges.

4.3 Full Refund Conditions

A full refund is possible only if the voucher hasn’t been redeemed and is applicable in cases like store closure or other issues related to redemption.

4.4 Cancellation Process

Once a refund has been requested, vouchers/voucher books will be cancelled from the ScoopFun system. The customer agrees not to attempt to redeem the vouchers while the refund is under process or once approved.

4.5 Post-Approval

Once a refund is approved, the voucher code will be deleted from the system, preventing further redemption attempts.

4.6 Refund Scenarios

Refunds will be granted in scenarios like store closure, disputes over unused vouchers, customers' unforeseen situations, and inability to redeem the voucher.

4.7 Reason and Proof

ScoopFun requires a reason and proof from customers requesting a refund.

4.8 Expired Vouchers

Refunds will only be processed for vouchers that are not expired. No refund will be given for expired vouchers.

4.9 Partial Refund for Voucher Books

Refunds will be given for only non-used vouchers from the book. Partial refunds will be processed if some vouchers from the book have already been used.

4.10 Refund Method

Refunds will be processed using the same method customers used for payment to ScoopFun.

4.11 Request Submission

Refund requests must be made in writing from the same email address used in the profile.

4.12 Proof Requirement

ScoopFun may request additional proof for security during the refund request.

4.13 Processing Time

Refunds may take 7-10 working days depending on processing times and customer cooperation in providing security information requested by ScoopFun.

4.14 No Refund

From time to time, ScoopFun may run promotions to give away free vouchers or voucher books. No refunds will be provided for these free vouchers or voucher books.

4.15 Refund Amount

The maximum refund provided will be equivalent to the total amount spent on purchasing vouchers, subject to adjustments based on a prorated rate if any vouchers have already been redeemed. However, no refunds will be issued for vouchers that have expired, been used, or were offered free of charge. This policy ensures fairness while maintaining the integrity of the voucher system.

ScoopFun Obligations

5.1 Platform Availability

We will provide the ScoopFun platform for you to create and manage discount voucher offers.

5.2 Promotion and Visibility

We will promote your offers to ScoopFun users through the app, email notifications, and other marketing channels.

5.3 Support

We will offer customer support to assist with any issues related to the app's functionality and voucher redemption.

Fees

6.1 Fees to Merchants

ScoopFun does not charge any fees to merchants at this time.

6.2 Future Fee Changes

ScoopFun reserves the right to introduce fees in the future. Any changes to the fee structure will be communicated to merchants in advance.

6.3 Fees to Customers

This cost can be changed at any time without prior notice and will be displayed on the ScoopFun portal.

Intellectual Property

7.1 Merchant Content

You retain all rights to the content you upload to the ScoopFun app, including logos, images, and descriptions. By uploading content, you grant ScoopFun a non-exclusive license to use, display, and distribute this content for promotional purposes.

7.2 ScoopFun IP

All intellectual property related to the ScoopFun app, including trademarks, logos, and software, remains the exclusive property of ScoopFun.

Confidentiality

8.1 Confidential Information

Both parties agree to keep confidential any non-public information disclosed during the course of the partnership, including business strategies, customer data, and financial information.

Data Protection

9.1 Compliance

Both parties will comply with applicable data protection laws and regulations, including GDPR and CCPA, in handling personal data.

9.2 User Data

You agree not to misuse or exploit user data obtained through ScoopFun and will only use it for fulfilling voucher redemptions and providing customer service.

Termination

10.1 Termination by Merchant

You may terminate this agreement at any time by providing written notice to ScoopFun and ceasing all use of the app.

10.2 Termination by ScoopFun

We reserve the right to terminate this agreement and your access to the app at any time for violations of these terms and conditions or other reasons, with or without notice.

10.3 Post-Termination

Upon termination, any outstanding payments due to you will be processed, and you must remove all ScoopFun-related content from your promotional materials.

Liability and Indemnification

11.1 Limitation of Liability

ScoopFun will not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

11.2 Indemnification

You agree to indemnify and hold ScoopFun harmless from any claims, damages, or expenses arising from your use of the app or violation of these terms and conditions.

Dispute Resolution

12.1 Governing Law

This agreement will be governed by and construed in accordance with the laws of New Zealand.

12.2 Dispute Resolution

Any disputes arising from this agreement will be resolved through binding arbitration in accordance with New Zealand laws.

Modifications

13.1 Changes to Terms

ScoopFun reserves the right to modify these terms and conditions at any time. Changes will be communicated to you via email or through the app. Continued use of the app after such changes constitutes your acceptance of the new terms.

General Provisions

14.1 Entire Agreement

This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings.

14.2 Severability

If any provision of this agreement is found to be unenforceable, the remaining provisions will remain in effect.

14.3 Waiver

The failure of either party to enforce any right or provision of this agreement will not be deemed a waiver of such right or provision.
